If they replace it with something significantly different design wise, even if neither better worse, or the same, it canTm YES
Ie different color doesn't count as new but different shape in a meaningful way, or if it comes with a stopper or cover for the holes through which hot liquid can leak, that can qualify as YES

@gamedev okay, I'll go get a coffee. From later reading I think it's the entire state of CA, though. I was in UT a while back and they don't have them. In nevada the lack of stoppers led the coffeeshop I went to use this hard plastic sticker as a stopper for some reason

Similar issue of CA regulation, as background: CA limits water use by showerheads. Legally 1.8 although looking in hardware stores, most shower heads are 1.75 or less. But even in NV, which doesn't have such strict state based regulations, every showerhead in Lowe's hardware store was following the CA rules or a tougher one.
But, it's not illegal to buy much more powerful shower heads on ebay, and there are no compatibility issues to worry about since water pipe size is standard and they user a simple screw-on system.
@gamedev oh wow I just talked to the guy at my local Starbucks and he said they switched back to the cold drink tops! Still no stoppers but at least we're back to the status quo

@gamedev is San Mateo just in a hellish AB test? They also now make me use the weird always-empty mystery milk pitcher to add cream rather than adding it for me
